Traveler Terms and Conditions
The Contract
This Agreement ("Traveler's Terms and Conditions") is made and entered into on the date of travel commencement (as stated on the Travel Itinerary, sent within 24 hours upon receipt of your travel request) by and between Ascend Travel Management | GMDT Real Estate, LLC, a company organized under the laws of Oklahoma (hereinafter referred to as the "Service Provider"), with its principal office located at 6608 N Western Ave, Suite #3226, Oklahoma City, OK 73116, and the company or individual whose name and address appear in the Travel Itinerary ("Client").
1. Services Provided
The Service Provider agrees to provide the following travel-related services:
- Airline Ticketing
- Hotel Reservations
- Corporate Housing | BnB Accommodations
- Car Rentals
- Expense Management
- Travel Insurance
- 24/7 Traveler Support
2. Terms
This Agreement begins on the Departure Date in the Traveler Itinerary and concludes on the Arrival Date unless terminated earlier in accordance with this Agreement.
3. Booking Procedure
Clients must submit booking requests through the Service Provider’s online platform at www.ascendtripz.com or through a secure online form (Typeform). Communication for additional information will be via phone or email when necessary. Bookings should be made 2 weeks prior to the actual departure date.
4. Pricing and Payment Terms
4.1. The Service Provider shall provide pricing at the time of booking and may vary based on availability, seasonality, and other factors.
4.2. The Service Provider shall provide pricing for all services at the time of booking. However, all prices and rates are subject to change based on availability, seasonal fluctuations, and other factors beyond the Service Provider’s control.
THE SERVICE PROVIDER DOES NOT GUARANTEE ANY PRICES OR RATES AND SHALL NOT BE HELD RESPONSIBLE FOR ANY CHANGES IN RATES OR PRICES THAT MAY OCCUR AFTER THE INITIAL BOOKING.
4.3. Payment is required upon booking confirmation. (applicable to Air Travel, Hotel Room, Car Rentals, and Travel Insurance).
4.4. All payments shall be made in USD via Credit card or ACH.
5. Fees
The Service Provider’s fees shall be waived (no cost) throughout the duration of this agreement. However, the change in Service Provider’s fees is subject to business needs and might change. The Service Provider shall provide proper notice before changes in fees are implemented.
6. Cancellations and Refunds
6.1. Cancellation policies vary by service and will be provided at the time of booking.
6.2. Refunds will be processed according to the cancellation policy of the specific travel service providers.
7. Client Responsibilities
7.1. The Client is responsible for providing the method of payment information (bank info, credit card, or debit card).
7.2. The Client is responsible for providing accurate information for travel bookings.
7.3. The Client must ensure compliance with all travel regulations, including but not limited to visa requirements, health certifications, and passport validity.
8. Service Provider Responsibilities
8.1. The Service Provider shall use its best efforts to secure the requested bookings and reservations.
8.2. The Service Provider shall send the Travel Itinerary to the Client within 24 hours from when the request was received.
8.3. In the event of any issues, the Service Provider shall promptly notify the Client and will make reasonable efforts to resolve such issues.
8.4. The Service Provider arranges and makes reservations for services. The Service Provider does not directly offer any services such as flights, car rentals, hotel accommodations, or similar services.
9. Limitation of Liability
9.1. The Service Provider shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with this Agreement.
9.2. The Service provider is not responsible for delays or problems involving the services provided by the Airlines, Hotels, and Car Rental companies.
9.3. The Service Provider’s total liability for any direct damages shall not exceed the total amount paid by the Client to the Service Provider for the specific booking in question.
10. Confidentiality
Both parties agree to protect each other’s confidential information. Ascend Travel Management is committed to safeguarding your private data and will not sell, distribute, or share your personal information with any third party without your explicit consent. We follow strict confidentiality protocols to ensure that your sensitive data, including payment information and personal details, is securely protected throughout the entire travel process.
11. Termination
Either party may terminate this Agreement upon seven (7) days’ written notice if the other party breaches any material term of this Agreement and fails to remedy such breach within seven (7) days of notice.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma and the County of Oklahoma, without regard to its conflicts of law principles.
13. Dispute Resolution
Any disputes arising out of or relating to this Agreement shall be resolved through mediation. If mediation fails, the dispute shall be resolved through binding arbitration under the rules of the State of Oklahoma and the County of Oklahoma.
14. Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous negotiations, understandings, and agreements, whether written or oral, between the parties related to the subject matter of this Agreement. No amendment or modification of this Agreement shall be valid or binding unless in writing and signed by an authorized representative of each party. Each party acknowledges that it is not entering into this Agreement on the basis of, and has not relied upon, any representations not expressly contained herein.
15. Severance Clause
The Service Provider arranges and makes reservations for services. The Service Provider does not directly offer any services such as flights, car rentals, hotel accommodations, or similar services. If a court of competent jurisdiction finds any provision herein to be unenforceable, such provision shall be deemed stricken and all other provisions shall remain in full force and effect.
