Traveler Terms and Conditions
1. Services Provided
By entering your travel information into our online form, you agree to the following Traveler Terms and Conditions: Ascend Travel Management (referred to herein as “Ascend,” “we,” or “us”)
1.1 Ascend agrees to provide the following travel-related services:
- Airline Ticketing
- Hotel Reservations
- Corporate Housing | BnB Accommodations
- Car Rentals
- Expense Management
- Travel Insurance
- 24/7 Traveler Support
1.2 Ascend Travel Management is not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any third-party providers (e.g., airlines, hotels, rental car companies), nor for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
2. Terms
2.1 This Agreement begins on the Departure Date in the Traveler Itinerary and concludes on the Arrival Date unless terminated earlier in accordance with this Agreement.
3. Booking Procedure
3.1 Clients must submit booking requests through Ascend online platform at www.ascendtripz.com or through a secure online form (Typeform). Communication for additional information will be via phone or email when necessary. Bookings should be made two weeks prior to the actual departure date.
3.2 Booking requests should be made at least two weeks prior to departure. Requests made within two weeks of departure may be subject to additional fees, and Ascend does not guarantee availability.
4. Pricing and Payment Terms
4.1. The Ascend shall provide pricing at the time of booking, which may vary based on availability, seasonality, and other factors.
4.2. All payments shall be made in USD via Credit Card or ACH and are required upon booking confirmation for applicable services, including Air Travel, Hotel Room, Car Rentals, and Travel Insurance.
4.3 If payment is not received by the due date or fails (e.g., declined credit card or failed ACH), a late fee of 5% may be applied. Services may be canceled if payment is not resolved within 48 hours.
5. Fees
5.1. The service fee is based on the traveler’s selected service tier and is applied as a percentage of the total air ticket, hotel booking, and car rental cost:
- Basic Tier – 3% service fee
- Premier Tier – 10% service fee
- Elite Tier – 15% service fee
5.2. The Ascend reserves the right to adjust service fees based on business needs and will provide proper notice before implementing any changes.
5.3 Service fees may be adjusted in response to significant changes in vendor pricing, operational costs, or inflationary pressures. Clients will be notified of fee adjustments at least 30 days in advance.
6. Cancellations and Refunds
6.1. Cancellation policies vary by service and will be provided at the time of booking.
6.2. Refunds will be processed according to the cancellation policy of the specific travel service providers.
6.3 Ascend’s service fees are non-refundable, regardless of the third-party provider’s cancellation or refund policies, except where required by law.
7. Client Responsibilities
7.1. The Client is responsible for providing accurate payment information and ensuring compliance with all travel regulations, including visa requirements, health certifications, and passport validity.
8. Service Provider Responsibilities
8.1. The Ascend shall use its best efforts to secure the requested bookings and reservations.
8.2. In the event of any issues, the Ascend shall promptly notify the Client and make reasonable efforts to resolve them.
9. Limitation of Liability
9.1. The Ascend shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with this Agreement.
9.2. The Ascend is not responsible for delays or issues involving Airlines, Hotels, or Car Rental companies.
9.3. The Ascend total liability for any direct damages shall not exceed the total amount paid by the Client for the specific booking in question.
9.4 Ascend shall not be liable for any delay or failure in performance due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, labor disputes, or internet outages.
10. Confidentiality
10.1 Both parties agree to protect each other’s confidential information. The Ascend will not sell, distribute, or share personal information without explicit consent.
11. Termination
1.1 Either party may terminate this Agreement upon seven (7) days’ written notice if the other party breaches any material term of this Agreement and fails to remedy such breach within seven (7) days of notice.
11.2 A material breach includes but is not limited to non-payment, failure to provide necessary travel information, or violations of applicable laws. Upon termination, unused services will be refunded based on third-party refund policies; however, Ascend’s service fees remain non-refundable.
12. Governing Law
12.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma.
13. Dispute Resolution
13.1 Any disputes arising out of this Agreement shall first be resolved through mediation. If mediation fails, the dispute shall be resolved through binding arbitration in Oklahoma.
13.2 Each party shall bear its own legal and arbitration costs. However, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs associated with arbitration.
14. Entire Agreement
14.1 This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, written or oral.
15. Severance Clause
15.1 If any provision is found to be unenforceable, it shall be deemed stricken, and all other provisions shall remain in full force and effect.
